Article 1 - Purpose
These Terms of Service govern the rights, obligations, and responsibilities of SEOART ("SEOART," "we," "us," or "the Store") and each user in connection with the website, online store, artwork sales, and related services provided through seoartgallery.com.
These Terms apply to online transactions, account use, guest checkout, artwork orders, custom requests, payment, shipping, returns, and related customer support unless a separate written agreement applies.
Article 2 - Definitions
① "Store" means the online marketplace operated by SEOART to provide information about artworks and to conclude transactions for goods or services. Depending on context, it also refers to SEOART as the operating entity.
② "User" means any person who accesses or uses the Store, including both members and guests.
③ "Member" means a user who has registered an account and may use member services provided by the Store.
④ "Guest" means a user who uses the Store or places an order without registering an account.
⑤ "Artwork" or "goods" means paintings, framed works, commissioned works, custom-size works, and related products offered through the Store.
Article 3 - Publication and Amendment of Terms
① SEOART makes these Terms available on the website so that users can review them before using the Store or placing an order.
② Key transaction terms, including product details, pricing, shipping, return limitations, refund conditions, and any restrictions on custom or made-to-order works, may also be shown on product pages, checkout pages, policy pages, order confirmations, or customer support communications.
③ SEOART may amend these Terms when necessary for legal, operational, payment, logistics, product, or service reasons. Material changes will be posted on the website before they take effect, and changes that materially affect user rights will be given reasonable advance notice where required by applicable law.
④ Unless otherwise stated, amended Terms apply to orders placed after the effective date of the amendment. Orders already accepted by SEOART remain subject to the terms in effect at the time of order acceptance, unless the user and SEOART agree otherwise.
⑤ Matters not addressed in these Terms are governed by applicable laws, individual policies published by SEOART, and ordinary commercial practice.
Article 4 - Services Provided
SEOART provides the following services through the Store.
- Information about artworks, artists, specifications, pricing, availability, and related services
- Online order placement and purchase contract facilitation
- Production, inspection, packaging, and international delivery of purchased artworks
- Consultation and production management for custom, commissioned, or made-to-order artworks
- Customer support for order, shipping, return, refund, and product inquiries
- Other services designated by SEOART from time to time
Article 5 - Changes to Services and Service Interruption
① SEOART may modify product information, product availability, shipping options, payment methods, or service details when necessary due to inventory status, artist schedule, production limitations, material availability, carrier restrictions, system updates, legal requirements, or other operational reasons.
② SEOART may temporarily suspend the Store or related services due to maintenance, repair, replacement, system failure, communication interruption, payment processor issues, force majeure, security incidents, or other reasonable causes.
③ If a service interruption materially affects an accepted order, SEOART will use reasonable efforts to notify the affected user and provide an appropriate remedy, such as continued performance, cancellation, refund, or other support depending on the circumstances.
Article 6 - Accounts and Guest Checkout
① Users may use the Store as members or guests where guest checkout is available.
② A user applying for an account must provide accurate, current, and complete information. SEOART may refuse or later cancel registration if the information is false, incomplete, misleading, technically problematic, or otherwise inappropriate for account registration.
③ Members are responsible for keeping account information current and for maintaining the confidentiality of their login credentials.
④ Guest checkout users are responsible for providing accurate contact, shipping, and order information. SEOART is not responsible for delays, loss, failed delivery, or additional costs caused by incorrect or incomplete information provided by the user.
Article 7 - Account Suspension, Termination, and Withdrawal
① A member may request account withdrawal at any time, subject to processing needed for pending orders, legal retention obligations, fraud prevention, dispute handling, tax records, and payment records.
② SEOART may restrict, suspend, or terminate an account if the user provides false information, fails to pay amounts owed, interferes with another user's use of the Store, misuses the Store, infringes intellectual property, attempts fraud, abuses return or chargeback processes, or violates these Terms or applicable law.
③ Account termination does not affect obligations that arose before termination, including payment obligations, return obligations, intellectual property obligations, and dispute resolution provisions.
Article 8 - Notices
① SEOART may send notices to users by email, phone, SMS, account message, checkout notice, website notice, or other contact method provided by the user.
② General notices may be posted on the website. Notices that materially affect an individual order will be sent to the contact information provided for that order where reasonably possible.
③ Users are responsible for ensuring that contact information provided to SEOART is accurate and reachable.
Article 9 - Artwork Information and Handmade Variation
① SEOART makes reasonable efforts to provide accurate product names, images, descriptions, dimensions, materials, framing information, prices, and availability.
② Because many SEOART works are hand-painted, produced in limited inventory, or made to order, minor variations in brushwork, tone, texture, finish, canvas tension, frame appearance, and image display may occur. Such natural handmade or screen-display variations are not considered defects unless they materially differ from the order or product description.
③ Product images may be affected by lighting, monitor settings, photography, staging, and cropping. Dimensions should be reviewed before purchase, and users may contact SEOART before ordering if exact visual, color, placement, or size requirements are important.
Article 10 - Order Application and Customer Information
When placing an order, a user will provide or confirm information needed for the transaction, including the selected artwork, quantity, options, recipient name, shipping address, phone number, email address, payment method, policy acknowledgements, and any other information reasonably required for production, payment, customs, or delivery.
If SEOART needs to provide user information to a payment provider, carrier, customs broker, production partner, or other service provider to complete the order, SEOART will handle that information in accordance with the Privacy Policy and applicable law.
Article 11 - Order Acceptance and Contract Formation
① An order submitted through the Store is an offer to purchase the selected goods or services. SEOART may accept the order by sending an order confirmation, payment confirmation, production confirmation, shipment confirmation, or other acceptance notice.
② SEOART may refuse, cancel, or limit an order before acceptance if there is a pricing error, product information error, inventory shortage, production impossibility, payment failure, suspected fraud, shipping restriction, legal restriction, incorrect customer information, or other reasonable reason that makes order fulfillment inappropriate or impossible.
③ If SEOART cannot accept an order after payment has been authorized or captured, SEOART will cancel the order and issue a refund or take refund steps through the original payment method, subject to payment processor processing times.
Article 12 - Prices, Currency, and Payment
① Prices on the international Store are generally displayed in U.S. dollars unless otherwise stated. The final payable amount is shown at checkout before payment is submitted.
② SEOART may provide payment through PayPal, credit card, debit card, or other payment methods shown at checkout. Available payment methods may vary by country, device, order amount, fraud controls, or payment provider availability.
③ Users represent that they are authorized to use the selected payment method. SEOART may cancel or hold an order if payment is declined, reversed, disputed, flagged, or not completed.
④ Currency conversion, foreign transaction fees, card issuer fees, PayPal fees charged to the user, bank charges, and similar third-party charges are the user's responsibility unless otherwise required by applicable law.
Article 13 - Regional Price Adjustment
SEOART may apply a regional price adjustment at checkout based on the shipping country, logistics conditions, destination-specific fulfillment costs, tax treatment, or other order factors. When applied, the adjustment is shown before payment as a separate line item.
A regional price adjustment does not mean that the artwork itself is free or discounted to zero. It is an order-level adjustment used to keep the final checkout amount aligned with SEOART's international pricing and delivery policy.
Unless stated otherwise, SEOART's international orders include free shipping from South Korea, but customs duties, import taxes, brokerage fees, and destination-country charges are separate from SEOART's free shipping policy.
Article 14 - Order Confirmation, Changes, and Cancellation
① SEOART will provide an order confirmation or similar receipt after an order is submitted or accepted.
② Users should promptly review the order confirmation and contact SEOART immediately if any information is incorrect.
③ SEOART will make reasonable efforts to accommodate change or cancellation requests before production, packaging, or shipment begins. However, changes or cancellations may be limited after an order enters production, after a custom request is confirmed, after packaging begins, or after shipment is arranged.
④ If a user has already paid and the order is eligible for cancellation, SEOART will process the refund through the original payment method where possible.
Article 15 - Production, Dispatch, and Shipping
① SEOART ships from South Korea to available international destinations, including the United States, Canada, Australia, and other supported countries.
② SEOART provides free international shipping for eligible orders unless otherwise stated at checkout or agreed separately.
③ SEOART maintains limited inventory for quality control. If a work is not in stock, it may enter production after the order is placed. Production typically takes 7-10 business days unless a different timeframe is stated on the product page, at checkout, or in direct communication.
④ Oversized works, framed works, or fragile works may ship through international express mail, professional art logistics partners, specialist freight couriers, or other appropriate carriers selected by SEOART.
⑤ SEOART will use reasonable efforts to ship within the stated or estimated timeframe. If shipment is materially delayed beyond the promised timeframe, SEOART will notify the user where required and provide available options, which may include agreeing to the revised timing or cancelling for a refund before shipment.
⑥ Delivery dates are estimates unless expressly stated as guaranteed. Customs clearance, carrier handling, weather, holidays, remote-area delivery, recipient unavailability, and incorrect address information may affect delivery timing.
Article 16 - Customs, Duties, Taxes, and Import Charges
① International orders may be subject to customs duties, import taxes, VAT/GST, brokerage fees, customs inspection fees, or other destination-country charges.
② In many cases, an order may clear customs without additional duties or taxes. However, customs treatment can vary by destination country, product classification, declared value, carrier process, and changes in import rules. SEOART cannot guarantee that a shipment will be duty-free or tax-free.
③ Unless SEOART expressly states otherwise at checkout, customs duties, import taxes, VAT/GST, brokerage fees, customs inspection fees, carrier collection fees, and destination-country charges are not included in SEOART's product price, free shipping policy, or regional price adjustment, and are the responsibility of the recipient or purchaser.
④ SEOART is not responsible for customs delays, customs decisions, import restrictions, or charges imposed by destination-country authorities. Users are responsible for ensuring that the artwork can be lawfully imported to the destination country.
⑤ If a shipment is refused, unclaimed, abandoned, returned, delayed, or disposed of because the recipient does not pay required import charges or complete customs procedures, SEOART may deduct from any refund the actual costs incurred, including return freight, carrier charges, customs charges, storage, handling, and non-recoverable payment or logistics costs, to the extent permitted by applicable law.
Article 17 - Returns and Withdrawal
Returns accepted within 7 days of delivery
① For eligible non-custom orders, users may request a return within 7 days of delivery. The artwork must be unused, undamaged, and returned in its original condition with appropriate packaging.
② Users must contact SEOART before returning any artwork. Returns shipped without prior notice or agreement may be refused, delayed, or excluded from refund eligibility.
③ For change-of-mind returns, the customer is responsible for return shipping to South Korea using a tracked and adequately insured service. The customer is responsible for safe repackaging and for loss or damage during return transit unless applicable law requires otherwise.
④ SEOART may refuse a return or reduce the refund if the artwork is damaged, used, altered, missing components, inadequately packaged, or otherwise not returned in its original condition.
⑤ Nothing in these Terms limits any non-waivable rights a user may have under applicable consumer protection law.
Article 18 - Custom, Made-to-Order, and Non-Returnable Items
① Change-of-mind returns may be limited or unavailable for custom-commissioned works, made-to-order works, custom-size works, custom-framed works, works modified at the buyer's request, or works produced specifically for an individual order where resale through ordinary channels would be difficult.
② SEOART will identify material return limitations on the product page, during checkout, in direct communication, or through other appropriate notices before or during the order process.
③ Even where a custom or made-to-order work is not returnable for change of mind, the user may still be entitled to an appropriate remedy if the work arrives damaged, defective, incorrect, or materially inconsistent with the confirmed order.
Article 19 - Damaged, Defective, or Incorrect Items
① If an artwork arrives damaged, defective, or incorrect, the user must contact SEOART within 7 days of delivery at info@seoartgallery.com with the order number, packaging photos, artwork photos, and a description of the issue.
② SEOART may request additional photos, carrier inspection, packaging retention, or other reasonable information to assess the issue.
③ If SEOART confirms that the return or claim is due to damage, defect, incorrect item, or SEOART's error, SEOART will provide an appropriate remedy, which may include repair, replacement, remake, refund, partial refund, or other reasonable solution depending on the artwork and circumstances.
Article 20 - Refunds and Return Shipping Costs
① Refunds are issued after the returned artwork is received and inspected, unless SEOART determines that an earlier refund or other remedy is appropriate.
② Approved refunds are generally processed to the original payment method. Actual posting times depend on PayPal, card networks, banks, and other payment providers.
③ For change-of-mind returns, return shipping costs, customs duties, taxes, import fees, brokerage fees, carrier collection fees, and destination-country charges are not refundable unless applicable law requires otherwise or SEOART expressly agrees otherwise. Any outbound shipping or logistics fee that was separately charged at checkout is also not refundable unless applicable law requires otherwise.
④ If the return is due to damage, defect, incorrect item, or SEOART's error, SEOART will be responsible for reasonable return shipping or other remedy costs as required by applicable law and SEOART's return instructions.
⑤ SEOART does not charge a penalty merely because a user requests an eligible return, but the user remains responsible for costs allocated to the user under these Terms and the published Shipping & Returns policy.
Article 21 - Privacy
① SEOART collects and uses personal information only as reasonably necessary for account operation, order processing, payment, production, shipping, customs, customer support, fraud prevention, legal compliance, and other purposes described in the Privacy Policy.
② SEOART may share necessary order information with payment providers, carriers, logistics partners, customs-related service providers, IT service providers, and other vendors involved in providing the Store and fulfilling orders.
③ Details about collection, use, retention, disclosure, and user rights are provided in SEOART's Privacy Policy.
Article 22 - SEOART Obligations
① SEOART will use reasonable efforts to provide the Store and fulfill accepted orders in a stable and commercially reasonable manner.
② SEOART will not knowingly engage in conduct prohibited by applicable law or these Terms.
③ SEOART will use reasonable safeguards for user information and will not send marketing communications where the user has opted out or where such communications are prohibited by applicable law.
Article 23 - User Obligations
Users must not engage in the following conduct.
- Providing false, incomplete, misleading, or unauthorized information
- Using another person's identity, payment method, account, or contact information without authorization
- Interfering with the Store, other users, payments, security, logistics, or customer support operations
- Copying, scraping, modifying, reselling, or commercially exploiting Store content without permission
- Infringing SEOART's or a third party's intellectual property, privacy, publicity, or other rights
- Submitting fraudulent orders, abusive claims, improper chargebacks, or misleading return requests
- Using the Store for unlawful, harmful, defamatory, obscene, threatening, or otherwise inappropriate purposes
Article 24 - Intellectual Property
① All website content created or provided by SEOART, including text, images, artwork photographs, page design, product descriptions, logos, graphics, and other materials, is owned by SEOART or its licensors unless otherwise stated.
② Users may not reproduce, distribute, transmit, publish, sell, license, create derivative works from, or commercially use SEOART content without prior written permission.
③ Purchase of an artwork transfers ownership of the physical item only. It does not transfer copyright, reproduction rights, licensing rights, image rights, or other intellectual property rights unless expressly agreed in writing.
Article 25 - Third-Party Links and Services
The Store may include links to third-party websites, payment providers, shipping trackers, social platforms, or other services. SEOART is not responsible for third-party content, policies, availability, fees, acts, or omissions unless required by applicable law.
Article 26 - Dispute Resolution, Governing Law, and Mandatory Rights
① SEOART will make reasonable efforts to resolve legitimate complaints, order issues, and customer inquiries promptly. If immediate resolution is difficult, SEOART will inform the user of the reason and expected handling timeline where reasonably possible.
② Users should first contact SEOART through the contact information provided on the Store so that SEOART can review the order, payment, shipping, return, or product issue.
③ These Terms and transactions with SEOART are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles, except to the extent that mandatory consumer protection laws of the user's place of residence or destination country cannot be waived by contract.
④ Any dispute arising from or relating to these Terms or a transaction with SEOART may be submitted to a competent court or dispute resolution body under applicable law. Nothing in these Terms limits any non-waivable consumer rights or remedies that apply to the user.
